When your W-2 or 1099 is due

The IRS sets when you get your tax forms for the year before:
  • Your employer must give you your W-2 by January 31. The IRS gives each year’s exact date in its General Instructions for Forms W-2 and W-3.
  • A business that files a for you must give you a copy by January 31, or by the next business day when January 31 falls on a weekend or legal holiday.
Wages paid to employees go on a W-2, not a 1099-NEC. A 1099-NEC reports what a business paid someone who isn’t its employee for services in the course of its business. The business files one for each person it paid at least the IRS’s threshold during the year. The IRS sets these rules, and the current threshold, in its Instructions for Forms 1099-MISC and 1099-NEC. If you’re a contractor, the 1099 Every makes for you is a 1099-NEC, under 1099 Documents on My profile → Docs.
